Recent Changes to
Unemployment Insurance Law - Effective Jan. 1, 2012
Employer Protest Period
For all claims
filed on or after Jan. 1, 2012, the Employer Protest Period
is now 15 days.
This means you may request your first benefit check on the
16th day after you filed your claim, unless the 16th day
falls on a Saturday. In this case, you may request the next
day (Sunday).
Waiting Week
You must now
serve a one week waiting period per Benefit Year. Your
waiting week will always be your first payable week. You
will request benefits for a two week period. If you are
otherwise eligible, the amount of your first check will only
be for one week. Your maximum benefit amount will not
change.

IMPORTANT EUC and EB INFORMATION
Unemployment Benefits extended in Kentucky
Legislation to extend unemployment insurance benefits was
signed into law by President Obama December 23, 2011,
ensuring unemployment insurance benefits will be extended
until February, 2012. The bill extends the period during
which individuals may qualify for Emergency Unemployment
Compensation (EUC).
There is no increase in the number of weeks of EUC.
EUC will remain a 53-week program, broken down into four
tiers. Tier one is 20 weeks, tier two is 14 weeks, tier
three is 13 weeks and tier four is six weeks.
The
Extended Benefit (EB) program has also triggered back on in
Kentucky.
*EB
claims may be filed by those who have exhausted regular
unemployment insurance and EUC.
Existing EB claimants can now
claim their two weeks as usual. EB claims must be made via
the internet at
kewes.ky.gov.
The
non-reduction rule
that was in place under the previous extension remains in
place. The non reduction rule applies to claimants who
qualify for a regular unemployment insurance claim while
enrolled in the EUC program. If the new UI claim is $100 or
25% less than the EUC claim, claimants may remain enrolled
in EUC. If you have questions about this part of the
extension, please contact your local office.
